GENERAL


These papers comprise correspondence and other records of the Compensation Court set up under the New Zealand Settlements Act 1863 and Amendments. They relate to applications for compensation for Maori land taken under the Act in the Waikato area.



The Compensation Court was established to hear claims by 'loyal Maori' - those not in conflict with the Government - for the recovery of land confiscated under the Act.



The New Zealand Settlements Act 1863 authorised the taking of land from Maori for European settlement, and was used to punish 'rebellious' Maori by allowing the confiscation of their land. If the land had been sold before the court found in favour of the applicants, other land or monetary compensation might be awarded. At times, confiscated land was returned to people who were not its previous owners.



The records were held in the Hamilton office of the Department of Survey and Land Information.



Photocopies of these papers are held in the University of Waikato Library and Waitangi Tribunal, and another set of photocopies is held by Archives New Zealand in the Auckland office, listed with this same series number.
